Marina Deck & Fence is a deck builder and outdoor structures contractor serving residential customers in Marina, CA and surrounding Monterey County communities. Our services include, but are not limited to, custom deck design and construction, fence installation, pergola installation, patio covers, and related outdoor improvement work. The Site is used to provide information about our services and to facilitate estimate requests - it does not constitute a contract or guarantee of service availability.
Estimates provided by Marina Deck & Fence - whether by phone, email, form submission, or in-person site visit - are non-binding until a written contract is signed by both parties. Estimates are based on the information available at the time of the assessment and may change if the scope of work changes, materials costs change significantly before work begins, or site conditions discovered during work differ materially from those assessed during the estimate.
We do not guarantee that any estimate provided through the Site or by phone will match the final written contract price. A binding price is only established in a signed written agreement. Requesting an estimate does not create any obligation on either party.
Project start dates and timelines are provided in good faith and may be affected by permit review periods, material availability, weather, or other circumstances outside our control. We will communicate changes to scheduled timelines as promptly as possible.
Cancellation terms - including any deposit refund policies and notice requirements - are governed by the written contract signed for each project. If a project is cancelled after materials have been ordered or work has begun, the customer may be responsible for costs incurred up to the point of cancellation, as specified in the written contract. Questions about cancellation policies for a specific project should be directed to us before signing a contract.
Payment terms for each project are established in the written contract and may include a deposit before work begins, progress payments during construction, and a final payment upon project completion. The specific amounts and schedule will be stated clearly in your contract before you sign.
We accept payment by methods stated in the written contract. Invoices not paid by the due date may be subject to late fees as specified in the contract. We reserve the right to pause or stop work on a project if payments are not made on the agreed schedule.
Where a building permit is required by the City of Marina or other applicable authority, we will apply for the permit on your behalf as part of our standard process. You agree to provide accurate property information needed for permit applications and to disclose any homeowners association rules or deed restrictions that may affect the project. Delays in permit approval are not the responsibility of Marina Deck & Fence, and project timelines will be adjusted accordingly when permit review periods extend beyond estimates.
Marina Deck & Fence warrants its workmanship for a period specified in your written contract. Manufacturer warranties on materials such as composite decking, fasteners, and hardware are governed by those manufacturers' terms and are passed through to you to the extent we receive them.
Warranties do not cover damage caused by misuse, neglect, failure to follow recommended maintenance, acts of nature, settling of soil or foundations outside the project area, or modifications made by anyone other than Marina Deck & Fence.
The Site itself is provided "as is" without any warranty of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.
To the fullest extent permitted by law, Marina Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services. This includes, without limitation, loss of profits, loss of data, or damages arising from reliance on information provided on the Site.
In any case, our total liability for any claim related to a specific project shall not exceed the amount paid by you to us for that project under the written contract. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
If a dispute arises between you and Marina Deck & Fence regarding a project or these Terms, we ask that you contact us first to attempt to resolve the matter informally. Most issues can be resolved through direct communication, and we are committed to working through problems in good faith.
If informal resolution is not possible, disputes shall be resolved through binding arbitration in Marina, California, in accordance with the rules of a mutually agreed arbitration provider, unless applicable law requires otherwise. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Marina Deck & Fence.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to the arbitration clause above shall be brought in the appropriate courts located in California.
All content on the Site - including text, images, logos, and design elements - is the property of Marina Deck & Fence or its content providers and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or use any content from the Site without our prior written permission, except as permitted by law.
We reserve the right to update or change these Terms and Conditions at any time. Changes take effect when posted to the Site. The effective date at the top of this page will be updated when changes are made. Your continued use of the Site after changes are posted means you accept the revised Terms.
